DSL-based service delivered download speeds that were 82 percent of advertised speeds, while cable providers delivered 93 percent of advertised speeds, and fiber-based providers delivered 114 percent of advertised speeds, according to the #FCC report#
[~http://www.fcc.gov/measuring-broadband-america#read~], which was based on test results from 6,800 US residents. Results charted the performance of 13 service providers. Upload speeds during peak hours were 95 percent of the advertised speeds for DSL, 108
percent for cable ,and 112 percent for fiber. The new report represents a “significant improvement” over 2009 tests released in August 2010, the FCC said. The earlier FCC report concluded US customers were getting download speeds at half the advertised
speeds. Verizon, Cox, and Comcast topped most performance measurements. Cablevision’s download speed was only about 50% of what it promotes, however, according to the report – a finding the cable provider contested.

Apple Files Injunction Against Samsung for Australian Tablet

~Apple~ filed an injunction against ~Samsung Electronics~ in Australia, accusing it of copying Apple product designs in an attempt to confuse buyers, and forcing it to halt commercial ads already airing in the country, according to a report #published#
[~http://www.bloomberg.com/news/2011-08-01/apple-seeks-to-block-samsung-from-selling-tablet-in-australia.html~] by Bloomberg citing Federal Court Justice Annabelle Bennett in Sydney. The injunction cites 10 instances of patent infringement against
Samsung’s upcoming 10-inch tablet. Samsung claims its Australian version of the Galaxy Tab 10.1 is different from the US version – on which Apple’s patent infringement claims are based – and that Apple has no right to stop the Australian release. A hearing
is scheduled for August 29th. After Australia, Apple’s planning on filing import bans against Samsung products in numerous other countries. The dispute began in April, when Apple sued Samsung in the US, claiming the Galaxy products imitated the designs and
technologies used for its iPad and iPhone. Samsung – which supplies memory chips for Apple – retaliated with suits in South Korea, Japan, Germany, and the US.

blog detailing its belief that ~Microsoft~, ~Apple~, and other members of the “Rockstar” group are conspiring together to counteract the success of Android through anti-competitive means. Google’s evidence for this assertion includes the Rockstar group’s
winning bid of $4.5 billion for Nortel’s patent portfolio, an amount which Google said is more than 4 times the initial estimated sale price, as well as the Microsoft’s rash of patent suits based on Android technology, and its attempt to charge a $15
licensing fee for every Android device sold. In response to this, Google said it plans to continue to encourage the Department of Justice to examine the subsequent usage of the Nortel’s patents, and be on the lookout for anti-competitive practices from the
Rockstar group members. The search provider also said it plans to expand its own patent portfolio to better combat these alleged attacks on its ability to compete. For its part, Microsoft claimed it offered to bid jointly on the patents with Google, an
assertion it supported with a tweeted image of an email which included Google’s refusal.
