NYTimes: Google, Verizon Near Deal that Would End Net Neutrality

The New York Times reported that Google and Verizon are close to an agreement that could lay the foundation for a tiered system in which
some companies (e.g., Google’s YouTube) would pay to have Verizon route their content faster over the Internet, circumventing the long-standing and vigorously-debated policy of net neutrality and eventually “leading to higher fees for consumers,” the Times
said. Net neutrality is also a cornerstone of the FCC’s proposed plans to regulate broadband communications. The article cited “people close to the negotiations who were not authorized to speak publicly.” Those sources said an agreement could be reached as
soon as next week. If completed, Google, whose Android operating system powers many Verizon wireless phones, would agree not to challenge Verizon’s ability to manage its broadband Internet network as it pleased. A spokesman for Verizon said the company was
still engaged in larger talks to reach a consensus with participants in ongoing meetings with the FCC and declined to comment on other negotiations. A spokeswoman for Google also declined to comment. The Times concluded that, while a deal between Google
and Verizon would affect only those two companies, it could sway the opinions of lawmakers, many of whom have questioned the wisdom of the FCC’s plans to oversee broadband service. After the Times story was published, Verizon issued a statement saying “The
New York Times article regarding conversations between Google and Verizon is mistaken. It fundamentally misunderstands our purpose. As we said in our earlier FCC filing, our goal is an Internet policy framework that ensures openness and accountability,
and incorporates specific FCC authority, while maintaining investment and innovation. To suggest this is a business arrangement between our companies is entirely incorrect.”

Amazon and Apple Under Investigation for E-Book Prices Controlling

Amazon and Apple are under investigation by the Connecticut Attorney General’s Office for potential anti-competitive
behavior. The allegations are that so called most-favored nation (MFN) clauses signed between these two e-book sellers and publishing companies prevent the publishers from offering discounts to other book sellers without offering the same discounts to
Amazon and Apple. This could make it nearly impossible for other sellers to compete with the named companies’ prices, as the publishers would be unable to offer any significant discount. Among those publishers named in the investigation are Hachette,
HarperCollins, Macmillan Publishers, Simon & Schuster, and Penguin. The Attorney General’s announcement noted that e-book prices among the countries four largest sellers already seem to be locked in parity. The attorney general, Richard Blumenthal, has

GAO: FAA Needs Better Planning for Winter Weather Operations

Ice formation on aircraft can prove risky during winter weather and despite the efforts of the Federal Aviation Administration (FAA), concerns about safety remain. The Government Accountability Office (GAO) reviewed the extent to which commercial airplanes have experienced accidents and incidents related to icing, and the efforts of the FAA and others to improve safety in winter weather. After studying information from both
the FAA and the National Transportation Safety Board, the GAO reported that the FAA should develop a plan focused on winter operations holistically, because there are many vital elements to safe
operations in winter weather, including airport surface conditions, aircraft ground deicing, and air traffic handling of aircraft in icing conditions. Such a plan should be comprehensive to identify gaps or other areas that require improvement, the GAO
report said, and would assist FAA in developing an integrated approach to winter operations.

NOAA Still Expects Active Hurricane Season

The US National Oceanic and Atmospheric Administration said it now expects 14 to 20 tropical storms, with eight to 12 of those strengthening into hurricanes, during the six-month season that began on June 1. It said
four to six of these would become major hurricanes. Before the season began, NOAA had forecast 14 to 23 tropical storms, with eight to 14 developing into hurricanes, and three to seven becoming major hurricanes. The updated forecast reflects the lower-than-expected number of storms that developed in June and July. “We’re still predicting a very active hurricane season and it’s very
important that people understand that,” said Gerry Bell, the lead hurricane forecaster with NOAA’s Climate Prediction Center.

OMB to Flag Problem IT Projects

NextGov reported that US federal agencies will begin flagging about 30 high-risk information technology projects that could be scrapped in the fiscal 2012 budget if they are not improved by this Winter. The
NextGov article was based on information from the Office of Management and Budget (OMB). The move to flag problem projects is part of an initiative launched in June to identify and fix the root causes of IT
project failures within the federal government. The effort also includes an ongoing freeze of all financial system modernizations to determine which ones should be canceled, as well as forthcoming recommendations for reforming the IT acquisition process.
Among the faltering programs that prompted the initiative are a financial system the Veterans Affairs Department canceled in June for the second time and a human resources system the Defense Department abandoned after spending 12 years and $1 billion
trying to integrate it departmen-twide. The OMB will announce the selections for its “hit list” by August 23.

has agreed to settlement provisions that go “beyond the terms applied to Intel in previous actions against the company,” the FTC said in a press release. Under the settlement, Intel will be prohibited
from: conditioning benefits to computer makers in exchange for their promise to buy chips from Intel exclusively or to refuse to buy chips from others; and retaliating against computer makers if they do business with non-Intel suppliers by withholding
benefits from them. Further, the settlement order will require Intel to: modify its intellectual property agreements with AMD, Nvidia, and Via so that those companies have more freedom to consider mergers or joint ventures; offer to extend Via’s x86
licensing agreement for five years beyond the current agreement, which expires in 2013; maintain a key interface, known as the PCI Express Bus, for at least six years in a way that will not limit the performance of graphics processing chips; and disclose
to software developers that Intel computer compilers discriminate between Intel chips and non-Intel chips, and that they may not register all the features of non-Intel chips. Intel also will have to reimburse all software vendors who want to recompile

Two Persian Gulf Countries Ban BlackBerry

According to Ars Technica, it is official: Saudi Arabia has become the second country in a week to block access to BlackBerry devices (made by RIM) on grounds of national security.
According to Ars Technica, the Saudi government laid blame for the situation on local wireless providers and on RIM, which uses encryption that apparently cannot be easily cracked. The encryption used by RIM was good enough to thwart the security service
in nearby United Arab Emirates, which earlier this week also blocked BlackBerry service until it could get access to people’s messages. Later in the week, the Associated Press reported that Indonesia is also considering
banning BlackBerry services, adding to the pressure on RIM to give governments greater access to data transmitted via the smartphone.

Apple to Release Fix for iOS Security Flaw

Apple plans to release a fix for two security
flaws in its mobile device operating system when it sends out its next software
update, according to a Bloomberg report.
The flaws in iOS – which runs on iPhones, iPads and iPods – came to light
earlier this week and could give malicious attackers the ability to gain
complete control over other users’ mobile devices. The security vulnerabilities
are in Apple’s iOS versions 3 and 4 for the iPhone and iPod, as well as iPads
running iOS version 3. When customers using the Mobile Safari Web browser land
on a malicious Web site and try to open a PDF document, a hacker can take
advantage of a memory corruption error when processing certain data in the
document, exploit the flaw to execute arbitrary code, and take over the device.
Until Apple releases the security update, customers should avoid opening PDFs or
clicking on links in emails unless they know who sent them the information.
